AGENCY: The School Board of Seminole County, Florida.

TITLE OF EMERGENCY POLICY: Use of Teleconferencing and Communications Media Technology for Meetings

PURPOSE AND EFFECT: The emergency policy is in response to the Novel Coronavirus Disease 2019 (“COVID-19) pandemic and the ongoing need to provide the School Board and schools with mitigating measures that may assist in holding meetings, particularly large advisory committee meetings, in a manner that fosters participation and adherence to social distancing guidelines from national, state and local public health entities.

STATUTORY AUTHORITY: 120.54; 286.011, 286.0114, 286.012,1001.32, 1001.41, F.S.

LAWS IMPLEMENTED: 1001.372(4) 1001.452, F.S.

SPECIFIC REASONS FOR FINDING AN IMMEDIATE DANGER TO THE PUBLIC, HEALTH, SAFETY OR WELFARE: Due to the current COVID-19 pandemic, which has caused many declarations by the Governor and health organizations, the Superintendent finds that there is an immediate need to provide explicit guidance regarding available measures for holding meetings that are governed by Florida’s Sunshine Law.

REASONS FOR CONCLUDING THAT THE PROCEDURE USED IS FAIR UNDER THE CIRCUMSTANCES: The notice will include notification of the proposed policy regarding Use of Teleconferencing and Communications Media Technology for Meetings in the newspaper, and the text of the proposed policy is being made available to the public in advance of the meeting via the School Board’s meeting agenda materials on the District’s website.  The proposed emergency policy takes only that action necessary to protect the public interest under the emergency procedure.

SUMMARY: On March 9, 2020, Governor DeSantis issued Executive Order 20-52 declaring a state of emergency for the state of Florida due to COVID-19.  On November 3, 2020, Governor DeSantis issued Executive Order 20-276, extending the declaration of state of emergency due to the ongoing impact of COVID-19 in Florida.  As COVID-19 continues to pose a threat to public health in the State of Florida and requires that ongoing measures be taken to protect the public, the Superintendent recommends providing guidance as to available measures that may be taken when holding meetings that are subject to Florida’s Sunshine Law.  The person to be contacted regarding the proposed policy adoption and a copy of the policy, is Jill Mahramus, School Board Clerk, Seminole County Public Schools, 400 E.
