FLORIDA RESILIENCY AND ENERGY DISTRICT

NOTICE OF INTENT TO USE UNIFORM METHOD OF

COLLECTING NON-AD VALOREM ASSESSMENTS

 

The Florida Resiliency and Energy District (the "District" or "FRED") hereby provides notice, pursuant to Section 197.3632(3)(a), Florida Statutes, of its intent to use the uniform method of collecting non-ad valorem special assessments to be levied by it over a number of years to fund the cost of qualifying renewable energy, energy efficiency and conservation and wind resistance improvements (collectively, "Qualifying Improvements") for those property owners who wish to undertake such improvements within the unincorporated areas of Sarasota County, Florida and any participating incorporated municipality, town or village within the above designated county; as authorized by Sections 163.08 and 197.3632, Florida Statutes, which will allow such assessments to be collected annually, commencing in November 2020, in the same manner as provided for ad valorem taxes.

 

The non-ad valorem special assessments to be levied by the District are voluntary and only imposed with the written consent of a property owner wishing to finance Qualifying Improvements.  The governing board of the District will consider the adoption of a resolution electing to use the uniform method of collecting such assessments authorized by Sections 163.08 and 197.3632, Florida Statutes, at a public hearing to be held on March 6, 2020 at 1:30 p.m., or as soon thereafter as the matter may be heard, in the Conference Room of the City of Fernandina Beach, located at 204 Ash Street, Fernandina Beach, FL 32034.  Such resolution will state the need for the levy by the District and will contain a legal description of the jurisdictional boundaries of the District.  Copies of the proposed form of resolution may be obtained from the Florida Resiliency and Energy District at 407-712-6352.  All interested persons are invited to attend.

The purpose of the Public Hearing is for the Board to consider the following Resolutions:

 

1.  Notice of Intent Resolution No. F20-05. The title of the Resolution is as follows:

 

RESOLUTION NO. F20-05

A RESOLUTION OF THE FLORIDA RESILIENCY AND ENERGY DISTRICT ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON-AD VALOREM SPECIAL ASSESSMENTS LEVIED WITHIN ITS JURISDICTIONAL BOUNDARIES OF SARASOTA COUNTY, FLORIDA ; STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE.

 

2.  Final Assessment Resolution No. F20-06, Relating to Special Assessment PACE Revenue Bonds (Florida HERO Program)(Residential Property – Phase Two) Series No. 200130-FL-RA.  The title of the Resolution is as follows:

 

RESOLUTION NO. F20-06

A RESOLUTION OF THE FLORIDA RESILIENCY AND ENERGY DISTRICT RELATING TO THE FINANCING OF QUALIFYING IMPROVEMENTS UNDER THE FLORIDA PROPERTY ASSESSED CLEAN ENERGY (PACE) ACT; ESTABLISHING THE TERMS AND CONDITIONS AND IMPOSING SPECIAL ASSESSMENTS RELATED TO SUCH QUALIFYING IMPROVEMENTS; APPROVING THE ASSESSMENT ROLL; DIRECTING THAT THE ASSESSMENT ROLL BE CERTIFIED TO THE APPROPRIATE TAX COLLECTORS; PROVIDING FOR COLLECTION OF THE ASSESSMENTS; AND PROVIDING FOR AN EFFECTIVE DATE.

 

3.  Final Assessment Resolution No. F20-07, Relating to Special Assessment PACE Revenue Bonds (Florida HERO Program)(Residential Property – Phase Two) Series No. 200227-FL-RA.  The title of the Resolution is as follows:

A RESOLUTION OF THE FLORIDA RESILIENCY AND ENERGY DISTRICT RELATING TO THE FINANCING OF QUALIFYING IMPROVEMENTS UNDER THE FLORIDA PROPERTY ASSESSED CLEAN ENERGY (PACE) ACT; ESTABLISHING THE TERMS AND CONDITIONS AND IMPOSING SPECIAL ASSESSMENTS RELATED TO SUCH QUALIFYING IMPROVEMENTS; APPROVING THE ASSESSMENT ROLL; DIRECTING THAT THE ASSESSMENT ROLL BE CERTIFIED TO THE APPROPRIATE TAX COLLECTORS; PROVIDING FOR COLLECTION OF THE ASSESSMENTS; AND PROVIDING FOR AN EFFECTIVE DATE.

 

4.  Final Assessment Resolution No. F20-08, Relating to Special Assessment PACE Revenue Bonds (Florida PACEfunding Program)(Residential Property – Phase One) Series No. 20200212.  The title of the Resolution is as follows:

 

RESOLUTION NO. F20-08

A RESOLUTION OF THE FLORIDA RESILIENCY AND ENERGY DISTRICT RELATING TO THE FINANCING OF QUALIFYING IMPROVEMENTS UNDER THE FLORIDA PROPERTY ASSESSED CLEAN ENERGY (PACE) ACT; ESTABLISHING THE TERMS AND CONDITIONS AND IMPOSING SPECIAL ASSESSMENTS RELATED TO SUCH QUALIFYING IMPROVEMENTS; APPROVING THE ASSESSMENT ROLL; DIRECTING THAT THE ASSESSMENT ROLL BE CERTIFIED TO THE APPROPRIATE TAX COLLECTORS; PROVIDING FOR COLLECTION OF THE ASSESSMENTS; AND PROVIDING FOR AN EFFECTIVE DATE.

 

The Board may also consider any other business which may properly come before it.

The meetings are open to the public and conducted in accordance with the provisions of Florida law. Meetings may be continued as found necessary to a time and place specified on record.

 

If any person decides to appeal any decision made with respect to any matter considered at this meeting, such person will need a record of the proceedings and such person may need to ensure that a verbatim record of the proceedings is made at his or her own expense and which record includes the testimony and evidence on which the appeal is based.
