Early Notice and Public Review of a Proposed Activity

in a 100-Year Floodplain

To: All Interested Agencies, Groups and Individuals

 

This is to give notice that the Florida Department of Commerce (FloridaCommerce) has been awarded federal Community Development Block Grant funds to address disaster recovery needs in 20 Florida Counties associated with major disasters occurring in 2022 from the U.S. Department of Housing and Urban Development (HUD) in accordance with Federal Register Volume 88, No. 96.  FloridaCommerce is conducting a Tier I Broad Level environmental review of proposed Rebuild Florida Housing Repair and Replacement Program (HRRP) activities and projects. The currently awarded funds will be designated for homes that received damage associated with Hurricane Ian. However, FloridaCommerce may expand the program to include homes damaged by Hurricane Nicole if HUD allocates funding to the state of Florida for that purpose in the future. Expansion of the program to include homes impacted by Hurricane Nicole is not anticipated to change project boundaries due to the overlapping areas of impact for Hurricanes Ian and Nicole.

 

FloridaCommerce has determined that Rebuild Florida HRRP includes activities that will be located in the 100-year floodplain and in wetlands. However, no project activities will result in new construction in a wetland. Accordingly, FloridaCommerce will be identifying and evaluating practicable alternatives to locating projects in the floodplain and the potential impacts on the floodplain from the proposed actions. This notice is required by Executive Order 11988, in accordance with HUD Regulations found at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.

 

FloridaCommerce is interested in alternatives and public perceptions of possible adverse impacts that could result from the project, as well as potential mitigation measures. Through Rebuild Florida, home repairs, reconstruction or replacement may be performed on properties located within the floodplain area. At this time, the exact number and locations of the properties to participate in the program are unknown. However, eligible applicants are homeowners whose primary residence was damaged by Hurricane Ian within the following counties. The number of 100-year floodplain acres is provided for each county; acres are listed per county in parenthesis. Brevard (335,815 acres), Charlotte (136,547), Collier (1,239,834), DeSoto (116,735), Flagler (116,033), Glades (222,685), Hardee (104,567), Hendry (214,018), Highlands (335,449), Hillsborough (429,838), Lake (334,867), Manatee (114,763), Monroe (628,723), Okeechobee (232,007), Osceola (494,576), Pinellas (65,214), Polk (535,249), Putnam (174,888), Seminole (59,112) and St. Johns (131,524). In total, there are approximately 6,022,444 acres across the 20-county region located within the 100-year floodplain.

 

Rebuild Florida HRRP will consist of one or more of the following activities:

 

•  Repair, reconstruction or replacement of housing units damaged by the 2022 hurricanes, which may include code compliance and mitigation against future storm impacts, including elevation.

•  The completion of work to homes that have been partially repaired.

•  Relocation of manufactured, modular and mobile homes impacted by the 2022 hurricanes to a previously developed mobile home lot with utilities already in place.

•  Temporary Housing Assistance based on individual homeowner needs and their participation in HRRP.

•  Temporary Housing Assistance based on individual tenant needs and their participation in HRRP.

•  Repairs to seawalls that were damaged by the 2022 hurricanes and are necessary to stabilize property and control erosion on a site also receiving assistance for home repair, reconstruction or replacement.

•  FloridaCommerce may also consider providing reimbursement for repairs to housing units damaged by the 2022 hurricanes that were completed prior to the homeowner’s application for the Rebuild Florida program.

 

For homes located in the 100-year floodplain, one of the following options may be administered:

 

Option A: Homes to be rebuilt in their original location are to be elevated, adhering to federal, state and local requirements, and at least two feet above base flood elevation.

 

Option B: Mobile Home Units may be replaced with modular units and elevated, adhering to federal, state and local requirements, and at least two feet above base flood elevation.

 

Option C: Damaged homes may be relocated within the homeowner’s currently developed property with possible elevation in accordance with floodplain requirements.

 

Option D: Relocation and replacement of damaged mobile homes to a previously developed mobile home lot outside the 100-year floodplain.

 

All homes assisted through the program within the 100-year floodplain will require the maintenance of floodplain insurance in perpetuity.

 

Floodplains and wetlands are beneficial for wildlife, creating a variety of habitats for fish and other animals. In addition, floodplains are important to the storage and conveyance of storm water, water quality protection, and recharge of groundwater. Coastal floodplains are recognized for their importance to estuarine and marine fisheries, waterfowl and other wildlife.

 

There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public education tool. The dissemination of information and request for public comment about floodplains or wetlands can facilitate and enhance federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

Aviso temprano y revisión pública de una actividad propuesta en una llanura aluvial de 100 años

Esto es para notificar que el Departamento de Comercio de Florida (FloridaCommerce por sus siglas en Ingles) ha recibido fondos federales de Subvención en Bloque para el Desarrollo Comunitario para abordar las necesidades de recuperación de desastres en 20 condados de Florida asociados con desastres mayores que ocurrieron en 2022 del Departamento de Vivienda y Desarrollo Urbano de EE. UU. (HUD por sus siglas en Ingles) de acuerdo con el Registro Federal Volumen 88, No. 96. FloridaCommerce está realizando una revisión ambiental de Nivel I de Nivel Amplio de las actividades y proyectos propuestos del Programa de Reparación y Reemplazo de Viviendas Rebuild Florida (HRRP por sus siglas en Ingles). Los fondos actualmente otorgados se destinarán a viviendas que sufrieron daños asociados con el huracán Ian. Sin embargo, FloridaCommerce puede expandir el programa para incluir viviendas dañadas por el huracán Nicole si HUD asigna fondos al estado de Florida para ese propósito en el futuro. No se anticipa que la expansión del programa para incluir hogares afectados por el huracán Nicole cambie los límites del proyecto debido a las áreas de impacto superpuestas de los huracanes Ian y Nicole.

 

FloridaCommerce ha determinado que Rebuild Florida HRRP incluye actividades que se ubicarán en la llanura aluvial de 100 años y en humedales. Sin embargo, ninguna actividad del proyecto resultará en una nueva construcción en un humedal. En consecuencia, FloridaCommerce identificará y evaluará alternativas viables para ubicar proyectos en la llanura aluvial y los impactos potenciales en la llanura aluvial a partir de las acciones propuestas. Este aviso es requerido por la Orden Ejecutiva 11988, de acuerdo con las Regulaciones de HUD que se encuentran en 24 CFR 55.20 Subparte C Procedimientos para Tomar Determinaciones sobre Manejo de Llanuras Inundables y Protección de Humedales.

 

FloridaCommerce está interesado en las alternativas y las percepciones públicas de los posibles impactos adversos que podrían resultar del proyecto, así como las posibles medidas de mitigación. A través de Rebuild Florida, se pueden realizar reparaciones, reconstrucciones o reemplazos de viviendas en propiedades ubicadas dentro del área de la llanura aluvial. En este momento, se desconoce el número exacto y la ubicación de las propiedades que participarán en el programa. Sin embargo, los solicitantes elegibles son propietarios cuya residencia principal fue dañada por el huracán Ian dentro de los siguientes condados. Se proporciona el número de acres de llanuras aluviales de 100 años para cada condado; los acres se enumeran por condado entre paréntesis. Brevard (335,815 acres), Charlotte (136,547), Collier (1,239,834), DeSoto (116,735), Flagler (116,033), Glades (222,685), Hardee (104,567), Hendry (214,018), Highlands (335,449), Hillsborough (429,838), Lake (334,867), Manatee (114,763), Monroe (628,723), Okeechobee (232,007), Osceola (494,576), Pinellas (65,214), Polk (535,249), Putnam (174,888), Seminole (59,112) y St. Johns (131,524). En total, hay aproximadamente 6,022,444 acres en la región de 20 condados ubicada dentro de la llanura aluvial de 100 años.

Rebuild Florida HRRP consistirá en una o más de las siguientes actividades:

 

•  Reparación, reconstrucción o reemplazo de unidades de vivienda dañadas por los huracanes de 2022, lo que puede incluir el cumplimiento del código y la mitigación de futuros impactos de tormentas, incluida la elevación.

•  La finalización de obra en viviendas que hayan sido parcialmente reparadas.

•  Reubicación de casas prefabricadas, modulares y móviles afectadas por los huracanes de 2022 a un lote de casas móviles previamente desarrollado con servicios públicos ya instalados.

•  Asistencia de Vivienda Temporal basada en las necesidades individuales de los propietarios y su participación en HRRP.

•  Asistencia de Vivienda Temporal basada en las necesidades individuales de los inquilinos y su participación en HRRP.

•  Reparaciones a el rompeolas que fueron dañados por los huracanes de 2022 y que son necesarios para estabilizar la propiedad y controlar la erosión en un sitio que también recibe asistencia para la reparación, reconstrucción o reemplazo de viviendas.

•  FloridaCommerce también puede considerar proporcionar un reembolso por las reparaciones de las unidades de vivienda dañadas por los huracanes de 2022 que se completaron antes de la solicitud del propietario para el programa Rebuild Florida.

 

Para viviendas ubicadas en la llanura aluvial de 100 años, se puede administrar una de las siguientes opciones:

 

Opción A: Las casas que se reconstruirán en su ubicación original deben estar elevadas, de conformidad con los requisitos federales, estatales y locales, y al menos dos pies por encima de la elevación base de inundación.

 

Opción B: Las unidades de vivienda móvil pueden reemplazarse con unidades modulares y elevadas, de conformidad con los requisitos federales, estatales y locales, y al menos dos pies por encima de la elevación de inundación base.

 

Opción C: Las casas dañadas pueden reubicarse dentro de la propiedad desarrollada actualmente del propietario con posible elevación de acuerdo con los requisitos de la llanura aluvial.

 

Opción D: Reubicación y reemplazo de casas móviles dañadas a un lote de casas móviles previamente desarrollado fuera de la llanura aluvial de 100 años.

 

Todos los hogares asistidos a través del programa dentro del terreno inundable de 100 años requerirán el mantenimiento de un seguro de terreno inundable a perpetuidad.

 

Las llanuras aluviales y los humedales son beneficiosos para la vida silvestre, creando una variedad de hábitats para peces y otros animales. Además, las llanuras aluviales son importantes para el almacenamiento y transporte de aguas pluviales, la protección de la calidad del agua y la recarga de aguas subterráneas. Las llanuras aluviales costeras son reconocidas por su importancia para las pesquerías marinas y de estuarios, las aves acuáticas y otros animales salvajes.

 

Hay tres propósitos principales para este aviso. En primer lugar, las personas que puedan verse afectadas por las actividades en las llanuras aluviales y aquellas que tengan interés en la protección del entorno natural deben tener la oportunidad de expresar sus preocupaciones y brindar información sobre estas áreas. Se alienta a los comentaristas a ofrecer sitios alternativos fuera de la llanura aluvial, métodos alternativos para cumplir el mismo propósito del proyecto y métodos para minimizar y mitigar los impactos. En segundo lugar, un programa adecuado de notificación pública puede ser una importante herramienta de educación pública. La difusión de información y la solicitud de comentarios públicos sobre las llanuras aluviales o los humedales pueden facilitar y mejorar los esfuerzos federales para reducir los riesgos e impactos asociados con la ocupación y modificación de estas áreas especiales. En tercer lugar, para ser justos, cuando el gobierno federal determina que participará en acciones que se lleven a cabo en las llanuras aluviales, debe informar a aquellos que pueden correr un riesgo mayor o continuo
